CAN A NOTARY PREPARE A LIVING TRUST?

No. A California notary public cannot draft a trust, select documents or provide legal advice unless separately qualified and authorized to do so. Cheri’s Notaries notarizes signatures on completed documents prepared by your attorney or authorized document preparer.

CAN YOU EXPLAIN MY TRUST DOCUMENTS?

We can explain the notarization procedure, but we cannot interpret the documents or explain their legal effect. Questions about the contents of your estate plan must be answered by your attorney.

DOES EVERY DOCUMENT IN A TRUST PACKAGE REQUIRE NOTARIZATION?

No. Some documents may require notarization, some may require witnesses and others may require only a signature. Your attorney should identify the requirements for each document.

CAN YOU TRAVEL TO A HOSPITAL OR NURSING HOME?

Yes. Cheri’s Notaries provides mobile appointments at hospitals, rehabilitation facilities, assisted living communities and nursing homes. The signer must be alert, willing to sign and able to communicate directly with the notary.

CAN YOU NOTARIZE FOR AN ELDERLY OR HOMEBOUND SIGNER?

Yes, provided the signer has acceptable identification, is willing to sign and can communicate an understanding of the transaction. If identification or competency may be a concern, please discuss the circumstances with us before scheduling.

CAN AN ATTORNEY SCHEDULE THE APPOINTMENT FOR A CLIENT?

Yes. Attorneys, paralegals and law firm staff may contact us directly to coordinate appointments for their clients.
